By purchasing/downloading/using a digital photo/photos from this website www.flyingparrot.com.au or our representative instagram/social media pages you, the client, is agreeing to a non-exclusive photo licensing agreement between the client or your representative and DS Media trading as Flying Parrot, trading online as www.flyingparrot.com.au.
The STANDARD LICENSE AGREEMENT is for LIMITED USE of each image for predominately NON-COMMERCIAL purposes.
The client agrees that, subject to the rights and licenses granted herein, DS Media, Flying Parrot and their representative website www.flyingparrot.com.au are, and will remain, the sole and exclusive owner of all right, title, and interest, throughout the world, to all photos and any copies of the photos. Except as expressly provided in this agreement, DS Media and it’s representatives reserve all rights and licenses not expressly granted in this Agreement.
STANDARD LIMITED USE LICENSE AGREES TO:
Single use of photo/photos for personal use, printing and framing.
Use of photo/photos for limited permitted commercial use as described below.
PERMITTED LIMITED COMMERCIAL USE INCLUDES:
On a website where the purpose of the website is for promotion of another business/activity not related to photography, printing or images.
On a flyer or advertisement where circulation and/or distribution does not exceed 50,000 in a single year and the business and/or it’s representatives are not promoting photos, printing or distribution of the photo/photos themselves.
LIMITED USE LICENSE DOES NOT INCLUDE:
Reproduction of photo/photos for large scale (exceeding 50,000 copies in one year) commercial redistribution - for example: magazines, digital magazines or promotions, postcards, prints, framed prints, mousemats, coasters, cups, hats, T-shirts or any other item and/or printed product designed for resale.
